Despite our efforts to provide useful and accurate information, errors may appear from time to time.  Before purchasing items, or services you've read about on this Website, you should confirm with the seller any information (including the price) that is important to your purchasing decision. 

Gilead Technology Group, LLC is not responsible for, and does not guarantee the condition, soundness, health, physical appearance, performance, or any other aspect of any listed horse.  Please independently verify information that is crucial to your decision making process.

Gilead Technology Group, LLC reserves the right to refuse access to the Website to anyone that does not comply with these terms of service.

Selling

The Website provides an advertisement listing service that brings together sellers of, and buyers looking for Kentucky Breeders’ Incentive Fund (KYBIF) horses.  The seller solely supplies the information contained in the advertisements, or other services available on the Website. 

Placing an advertisement on this website does not require the seller to sell the listed horse.  Responsibility for the information contained in advertisements lies exclusively with the seller.  You alone are responsible for material you post.

Buying

The price and other terms of any sale remain subject to direct negotiation between the buyer and the seller.  Gilead Technology Group, LLC will not be involved in any transaction, nor receive any commission or other compensation for the sale. 

The prices listed by sellers on the Website may exclude other charges, which may be added to the listed price to arrive at the final price of a particular item.  The buyer should confirm final and total pricing before purchasing.

We are unable to verify the information sellers supply or guarantee the horses sold as a result of an advertisement from this website.  We strongly suggest you obtain the services of a Veterinarian or other qualified individual, as applicable, to evaluate any horse you are considering.  Additionally, we cannot verify a horses’ KYBIF eligibility prior to advertisement placement.  The buyer should independently verify that the prospective horse meets the requirements for KYBIF eligibility. 

Advertisements

By placing an advertisement on our Website, you agree to pay the fees specified for the service(s) you select, regardless of whether your horse, or service sells as a result of the listing.  Take care in selecting your advertisement type and submitting your information.  We will provide modifications to your Ad for a nominal fee.  If we make a mistake in your Ad, we will correct it without charge to you.

Once the Ad is placed on the Website, there will be no refunds issued.  If requested in writing, and before the Ad goes onto the Website, a full refund may be issued.

When you provide us with content for an advertisement to be placed on the Website, you grant us an exclusive, worldwide, perpetual, irrevocable, royalty-free license to publish, display, transmit and make any other commercial use of that content in any media now existing or created in the future.  This license includes the right to store all content in an accessible archive.

Indemnity

You agree to indemnify and hold Gilead Technology Group, LLC and its members, and employees harmless from any damages arising out of any claims or demands; including reasonable attorney's fees, made by any third party due to or arising out of your breach of these Terms of Service, your use of the Website or you violation of any law or the rights of any third party.

Electronic Communications

No spamming or data scraping is allowed.  We want potential buyers visiting the Website to feel free to share their email addresses with those listing horses for sale on our site.  By listing a horse for sale on this site, you agree to use the email addresses of those responding to your listing only for purposes of communicating with them about the potential sale of that horse.  By using this Website, you agree not to use information concerning other users of the Website for any purpose other than to explore the potential purchase or sale of a listed horse.
